Defining elements

The Buyer is the individual or legal person, authorized person, association or foundation that issues an Order. The Seller is Sere Transilvania S.R.L., headquartered in Vâlcele, Feleacu commune, str. Principală nr. 355A, Cluj county county.

Goods and Services mean any product or service, including the documents and services mentioned in the Order, to be provided by the Seller to the Buyer. The Contract is an Order confirmed by the Seller.

Contractual documents

By issuing an electronic or phone order, the Buyer agrees with the form of communication through which the Seller carries out operations. The order consists of the order and its special conditions, the Buyer specifications where applicable, and these terms and conditions.

The Seller confirmation of the order implies complete acceptance of its terms. The Contract comes into force when the Seller confirms the Order by phone or email.

Seller obligations

The Seller will use professional and technical knowledge to deliver the Goods and Services that meet the requirements, needs and specifications of the Buyer. Information presented on the site has an informative character and may be modified without prior notice.

Product descriptions may be incomplete for reasons of space or coherence, but the Seller makes efforts to present the most relevant details. Images, multimedia presentations and related content are used exclusively for presentation purposes and do not represent separate contractual obligations.

Intellectual property and confidentiality

The Buyer understands intellectual property rights and will not disclose to third parties or make public any information received from the Seller. The site name, graphic signs, images and content are the exclusive property of Sere Transilvania.

Sere Transilvania applies the technical and organizational measures required to protect personal data. Information provided by the Buyer remains the property of the Seller and may be used only for contract execution or legal compliance.

Payment, delivery and warranties

Price, payment method and payment deadline are specified in the Order. For EU orders with a valid VIES code, invoicing is made without VAT; otherwise VAT is added according to Romanian law.

The Seller is obliged to dispatch the Goods and Services through courier or another agreed method. Acceptance takes place when the delivered goods and services comply with the technical characteristics mentioned in the Order. All products benefit from warranty conditions according to the legislation in force and the manufacturers commercial policies.

Return policy and liability

Buyers may return products in their original packaging within the legal timeframe. The return transport cost is paid by the Buyer, and the products must remain in a condition close to the one in which they were delivered.

The Seller cannot be responsible for damages suffered by the Buyer or any third party as a result of improper use of the Goods or Services after delivery, and especially not for product loss.

Force majeure and applicable law

Neither party shall be liable for non-performance of contractual obligations if such non-execution is due to a force majeure event. Force majeure is an unpredictable event outside the control of the parties and which cannot be avoided.

This contract is governed by Romanian law. Any litigation between Seller and Buyer will be settled amicably or, if that is not possible, by the competent Romanian courts. In disputes concerning interpretation of these terms, the Romanian text prevails.
